Secure land rights for women strengthen their position and role within the family structure, society, and the community. These land rights can be obtained through various legal mechanisms, including purchase, inheritance or donation, recognition through special adverse possession, and participation in the formal land registration process.<\/p>\n\n\n\n<p><strong>Evolution and Land Registration in Timor-Leste<\/strong><\/p>\n\n\n\n<p>Land registration establishes legal proof of land ownership, providing protection for land against fraud, disputes, or illegal processes. Historically, during the time of the ancestors, communities managed and distributed land through traditional norms and customary rules, the Portuguese and Indonesian administrations later initiated formal registration, distributing 2,709 certificates (Portuguese) and 44,091 (Indonesian), although these did not yet achieve complete land registration at the national level.&nbsp;<\/p>\n\n\n\n<p>Following independence, Timor-Leste strengthened its legal framework through Law No. 13\/2017, which created the National Land Registry as the official system<sup>1<\/sup>, and had register 54,558 land parcels from Ita Nia Rai project (2008\u20132012), while the National Cadaster System (SNC) has registered 326,111 land parcels (2014\u20132020), however, until now regarding the issue of inclusiveness, clear evidence has not yet been shown, which serves as a fundamental basis for transparency.<\/p>\n\n\n\n<p><strong>Land registration transparency builds trust and system integrity<\/strong><\/p>\n\n\n\n<p>When institutions maintain transparency in land registration, it demonstrates a primary element for strengthening the integrity of the land administration system. However, when there are restrictions on public access to data, it can lead to the abuse of power by influential groups, enable land price speculation based on their own interests, and reduce the reliability of issued titles. The Ministry of Justice, in the 2026 General State Budget, has reported a total of 326,111 registered land parcels and plans to attribute the land titles to 800 beneficiaries<sup>2<\/sup>. A major challenge remains in how to increase data transparency and ensure that women and vulnerable groups do not lose their land rights, while guaranteeing fairness for everyone. Nevertheless, the Government has not yet published disaggregated data (for women, men, and couples) regarding those who have already registered their land. There is a genuine need for the public to know specific data concerning what percentage of the total territory is already covered and what percentage remains involved in dispute cases, these details are truly fundamental to providing a pathway for the National Parliament and other sovereign bodies to exercise effective control over plans, policies, laws, and the inclusive allocation of state resources.<\/p>\n\n\n\n<p><strong>Social analysis guarantees that land registration is inclusive<\/strong><\/p>\n\n\n\n<p>While the Government has good intentions to expand land registration into rural areas, such programs often fail to ensure that women and vulnerable groups participate actively due to a lack of inclusive strategies and a failure to consider social norms that act as major barriers for them. A significant challenge lies in the perspective of land registration teams and the registration formats, which often focus on men as heads of households and prefer to record only a man\u2019s name or a single individual&#8217;s name, which negatively impacts women. Research conducted by Rede ba Rai in 2019 regarding SNC land registration showed that out of 10,652 declarations, women registered at 23.5% while men accounted for 63.3%<sup>3<\/sup>. Therefore, it is very important for the SNC to conduct a deep analysis of social impacts and customary rights regarding women&#8217;s land rights. When registering land in customary areas, it is better to wait until the law on Community Protection Zones is produced, so that land registration in customary areas does not create new illiterates but instead truly secures the land rights of women and vulnerable groups.<\/p>\n\n\n\n<p><strong>Between legal equality and social barriers to women&#8217;s land rights<\/strong><\/p>\n\n\n\n<p>Timor-Leste has a legal framework that protecting women&#8217;s land rights, one of which is Law No. 13\/2017, which guarantees equality between women and men in accessing, managing, and owning land property, including prohibiting any form of discrimination within community protection zones. Although the Government has made efforts through legislative changes and the implementation of land registration programs, the reality on the ground shows that inheritance within patrilineal systems remains a major barrier because social norms continue to dominate people&#8217;s decisions rather than formal laws. Research by Rede ba Rai in 2025<sup>4<\/sup>&nbsp;regarding women&#8217;s land tenure security in patrilineal systems indicates that many women receive land as an inheritance from their parents but are given the heavy responsibility of caring for their families, and the majority of these daughters continue to have the land registered in their parents&#8217; names because they lack technical knowledge on how to transfer the title, in addition to not yet knowing that their rights have adequate legal protection to guarantee their security as landowners.<\/p>\n\n\n\n<p><strong>Conclusion:&nbsp;<\/strong><\/p>\n\n\n\n<p>Although Timor-Leste has shown progress in land registration, the lack of transparency remains a major challenge because the Government does not provide in-depth data regarding gender issues, dispute cases, and actual progress throughout the territory. While several laws certainly provide legal protection for women, in practice, the deeply rooted patrilineal system and a lack of technical information continue to act as barriers that prevent women from safely enjoying their property rights.
